Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Colorful Aura Inc., a New York C Corporation ("Colorful Aura," "we," "us," or "our"), governing your use of the Morning Unlock iOS application and any related services (collectively, the "App").
By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not download or use the App.
These Terms are in addition to any terms imposed by Apple Inc. in connection with your use of the App Store. In the event of a conflict between these Terms and Apple's terms, Apple's terms govern solely with respect to Apple's obligations.
2. Definitions
- "App" means the Morning Unlock iOS application, including all features, content, and updates.
- "You" or "User" means any individual who accesses or uses the App.
- "Premium Features" means features available exclusively to subscribers, including Evening Downtime and the Journal.
- "Subscription" means a paid Monthly or Annual plan that unlocks Premium Features.
- "Free Trial" means the 7-day introductory trial period available to new subscribers.
- "User Content" means any content you create, upload, or submit through the App, including profile photos, challenge messages, and friend nudges.
- "HealthKit Data" means sleep session data read from Apple HealthKit with your explicit permission.
3. Eligibility
You must be at least 13 years of age to use the App. If you are located in a jurisdiction where a higher minimum age applies for consent to data processing or use of digital services, you must meet that higher age requirement. By using the App, you represent and warrant that you meet the applicable age requirement.
If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
4. Account Registration and Security
4.1 Account Creation
You must create an account to access the App's core features. You may register using an email address and password or via Google Sign-In. You agree to provide accurate, current, and complete information and to keep your account information updated.
4.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at info@colorfulaura.co if you suspect unauthorized access to your account.
4.3 One Account Per User
Each account is for a single individual. You may not share your account with others or allow third parties to access the App using your credentials.
5. Subscription Terms and In-App Purchases
5.1 Subscription Plans

5.2 Free Trial
New subscribers receive a 7-day free trial. The free trial is available only to users who have not previously subscribed. At the end of the trial, your subscription converts to a paid plan unless cancelled beforehand.
5.3 Auto-Renewal
Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.
5.4 Cancellation
Cancel at any time via iOS Settings → [Your Name] → Subscriptions → Morning Unlock Premium. Cancellation takes effect at the end of the current billing period.
5.5 Refunds
All payments are processed by Apple. To request a refund, visit reportaproblem.apple.com or contact Apple Support.
5.6 Beta Access
Users designated as beta testers prior to launch may be granted free access to Premium Features at our sole discretion. This access may be revoked at any time with or without notice.
5.7 Apple EULA
Your use of the App is also governed by Apple's Standard EULA: apple.com/legal/…/stdeula
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose.
- Reverse-engineer, decompile, or disassemble the App.
- Circumvent or interfere with any app-blocking mechanisms or authentication systems.
- Use automated scripts or bots to interact with the App.
- Attempt to gain unauthorized access to the App or its servers.
- Transmit viruses, malware, or harmful code.
- Collect personal information about other users without consent.
- Use the App to transmit unsolicited communications (spam).
7. Social Features and User-Generated Content
The App includes social features such as challenges, friend nudges, and profile pages. You are solely responsible for any content you post. You agree not to post content that is unlawful, harassing, defamatory, obscene, or that violates any third-party rights.
We reserve the right to remove content and suspend or terminate accounts that violate these standards.
8. User-Generated Content License
By submitting User Content, you grant Colorful Aura Inc. a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content solely for the purpose of operating the App. You retain ownership of your content. This license terminates when you delete your account or the content.
9. Intellectual Property
The App, including its design, code, graphics, and content, is owned by Colorful Aura Inc. and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
10. Health and Wellness Disclaimer
The App is not a medical device and does not provide medical advice. Sleep scores and insights are for informational purposes only and should not be used to diagnose or treat any health condition. Consult a qualified healthcare provider for any health concerns.
11. App Blocking Feature Disclaimer
The App's blocking features rely on Apple's Screen Time API. We do not guarantee that these features will function without interruption or that they cannot be circumvented. We are not liable for any harm resulting from the failure or circumvention of app-blocking features.
12. Third-Party Services
The App uses third-party services including Google Firebase, RevenueCat, and OpenAI. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service provider.
13. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
14. Children
The App is not directed at children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact us at info@colorfulaura.co.
15. Disclaimers and Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLORFUL AURA INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE TOTAL AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM OR $50.00 USD.
17. Indemnification
You agree to defend, indemnify, and hold harmless Colorful Aura Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the App, your violation of these Terms, or your User Content.
18. Termination
18.1 Termination by You
You may terminate your account at any time using the in-app delete-account flow or by emailing info@colorfulaura.co. Your data will be deleted within 30 days, except where retention is required by law.
18.2 Termination by Us
We may suspend or terminate your account at any time if you have violated these Terms or engaged in fraudulent conduct.
19. Governing Law and Dispute Resolution
19.1 Governing Law
These Terms are governed by the laws of the State of New York, United States.
19.2 Informal Resolution
Before any formal proceeding, contact us at info@colorfulaura.co to attempt informal resolution. We will respond within 30 days.
19.3 Binding Arbitration
Unresolved disputes shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, on an individual basis.
19.4 Class Action Waiver
YOU AND COLORFUL AURA INC. EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
20. Apple App Store — Additional Terms
These Terms are between you and Colorful Aura Inc. only, not Apple. Apple is not responsible for the App or its content. Colorful Aura Inc. — not Apple — is responsible for maintenance, support, product claims, and warranty obligations related to the App.
21. Modifications to These Terms
We may update these Terms at any time. Material changes will be communicated in-app or via email. Continued use after the effective date constitutes acceptance of the revised Terms.
22. Severability and Entire Agreement
If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Colorful Aura Inc. regarding the App.
